DAYDREAMER DOMES
OVERNIGHT & DAY PASS GUEST WAIVER, RELEASE OF LIABILITY & ASSUMPTION OF RISK AGREEMENT
PLEASE READ CAREFULLY. THIS AGREEMENT AFFECTS YOUR LEGAL RIGHTS.
THIS AGREEMENT INCLUDES A RELEASE OF LIABILITY FOR NEGLIGENCE AND IS GOVERNED BY MICHIGAN LAW.
By entering the DayDreamer Domes property, purchasing a day pass, checking in for an overnight stay, or participating in any activity or service on-site, you acknowledge that you have read, understand, and voluntarily agree to the terms of this Guest Waiver, Release of Liability, and Assumption of Risk Agreement (“Agreement”).
If you do not agree to this Agreement, you may not enter or remain on the property.
1. WHO THIS AGREEMENT APPLIES TO
This Agreement applies to all guests, visitors, patrons, invitees, and participants, including but not limited to individuals who are:
Staying overnight in domes or accommodations
Visiting on a public day pass
Dining at the restaurant or clubhouse
Purchasing or consuming food or beverages, including alcohol
Using the pool area, cabanas, turf, or outdoor amenities
Using spa or wellness services, including float tanks, sauna, sound therapy bed, or massage
Attending events, parties, or gatherings
Parking vehicles or traveling anywhere on the property
Entering any portion of the approximately 150-acre DayDreamer Domes property
Entry onto the property is expressly conditioned upon acceptance of this Agreement.
2. ASSUMPTION OF RISK
You understand and acknowledge that visiting DayDreamer Domes involves inherent and unavoidable risks, including risks that may result in personal injury, illness, disability, death, or property damage.
These risks include, but are not limited to:
GENERAL PROPERTY RISKS
Slips, trips, and falls on wet, uneven, or natural surfaces
Injuries related to stairs, decks, walkways, furniture, structures, or equipment
Exposure to weather conditions including heat, cold, rain, wind, lightning, and storms
Limited lighting in certain outdoor or undeveloped areas
OUTDOOR & LAND USE RISKS
Uneven terrain, natural obstacles, and undeveloped areas
Wildlife, insects, plants, and natural environmental conditions
Walking, exploring, or recreating across the entire property
POOL & WATER-RELATED RISKS
NO LIFEGUARD ON DUTY — SWIM AT YOUR OWN RISK
Drowning, slipping, falling, or injury in or around the pool
NO DIVING — SHALLOW WATER
Use of pool furniture, floats, cabanas, and surrounding surfaces
Alcohol is permitted in the pool area but not in the pool
Pool closures due to weather, safety, or operational reasons do not entitle guests to refunds
FOOD & ALCOHOL RISKS
Impaired judgment, coordination, or reaction time
Illness, injury, or death related to alcohol consumption
You voluntarily assume all known and unknown risks, whether arising from your actions, the actions of others, environmental conditions, or the condition of the property.
3. SPA, WELLNESS & MASSAGE SERVICES ACKNOWLEDGMENT
DayDreamer Domes offers spa and wellness services, which may include but are not limited to float tanks, sauna, sound therapy beds, and massage therapy services (“Spa Services”).
You acknowledge and agree that:
Spa Services involve physical contact, heat exposure, vibration, sound, and sensory stimulation, which carry inherent risks.
Risks may include soreness, bruising, muscle strain, dizziness, fainting, nerve irritation, discomfort, or aggravation of pre-existing conditions.
You affirm that you are physically and medically fit to participate in Spa Services.
You agree to disclose any medical conditions, injuries, pregnancy, sensitivities, or contraindications prior to receiving services.
You understand that Spa Services are not medical treatment, diagnosis, or therapy.
INDEPENDENT CONTRACTORS
You acknowledge that massage therapy and certain spa services may be provided by independent contractors who are not employees of DayDreamer Domes.
You agree that:
DayDreamer Domes is not responsible for the professional judgment, actions, or omissions of independent contractors to the fullest extent permitted by law.
The release and indemnification provisions of this Agreement apply equally to all spa service providers, including independent contractors.
4. ALCOHOL CONSUMPTION & MICHIGAN LAW
You certify that you are 21 years of age or older to purchase or consume alcohol.
You agree to consume alcohol responsibly and in compliance with Michigan law.
You agree not to drive or operate a vehicle while impaired.
DayDreamer Domes reserves the right to refuse alcohol service to any guest at any time.
You accept full responsibility for your conduct and actions while consuming alcohol.
5. RELEASE OF LIABILITY
To the fullest extent permitted by Michigan law, you hereby waive, release, and discharge DayDreamer Domes, its owners, operators, employees, contractors, independent contractors, vendors, affiliates, and agents from any and all claims, demands, causes of action, or liabilities arising out of or related to your presence on the property.
This release includes claims arising from the negligence of DayDreamer Domes, whether passive or active, except where prohibited by law.
6. INDEMNIFICATION
You agree to indemnify and hold harmless DayDreamer Domes from any claims, damages, losses, costs, or legal fees arising from:
Your actions or omissions
The actions or omissions of anyone in your party
Violations of this Agreement or posted rules
7. PROPERTY RULES, FOOD, PARKING & CONDUCT
OUTSIDE FOOD & BEVERAGES
Overnight guests may bring their own food and beverages for consumption inside their private Dome only.
Outside food or beverages are strictly prohibited in all common areas, including but not limited to:
GENERAL CONDUCT
No tailgating is permitted anywhere on the property, including parking areas or vehicles.
Guests are responsible for any damage to property caused by themselves or members of their party.
Parking is at your own risk. DayDreamer Domes is not responsible for theft, damage, or loss of vehicles or personal property.
Violations of these rules may result in immediate removal without refund.
8. MINORS — PARENTAL ASSUMPTION OF RISK
If I am accompanied by any minor children (under 18 years of age), I certify that I am the parent or legal guardian of such minor(s), or that I have legal authority to act on their behalf.
I acknowledge and agree that:
All rules, policies, and safety requirements apply equally to minors.
I assume full responsibility for the supervision, conduct, and safety of all minors in my care.
I voluntarily assume all risks on behalf of such minors.
I agree to indemnify and hold harmless DayDreamer Domes from any claims brought by or on behalf of any minor in my care, to the fullest extent permitted by Michigan law.
No adult guest may enter or remain on the property unless they have personally agreed to this Agreement.
9. RIGHT TO REFUSE ENTRY OR REMOVE GUESTS
DayDreamer Domes reserves the right to refuse entry or remove any guest at any time, for any reason, including but not limited to safety concerns, intoxication, rule violations, or operational needs.
No refunds will be issued.
10. SEVERABILITY & GOVERNING LAW
If any portion of this Agreement is deemed unenforceable, the remaining provisions shall remain in full force and effect.
This Agreement shall be governed by and interpreted in accordance with the laws of the State of Michigan.
11. FINAL ACKNOWLEDGMENT
By signing below or electronically indicating agreement, I confirm that:
I have read and understand this Agreement in its entirety
I understand that this Agreement includes a release of liability for negligence
I agree that entry to DayDreamer Domes is conditioned upon acceptance of this Agreement
I agree to be legally bound by its terms
