INTRODUCTION AND GENERAL PROVISIONS -

We lifted this from a well-known brand and augmented it for our purposes. It has been reviewed by legal, because well who comes up with the stuff? Lawyers, that’s who. Our comments are in pink, obvi.  

Your reservation and the accommodation agreement made with DayDreamer Domes™ (whether made by you directly with DDD or via a third party such as a travel agent) will be subject to these Reservation Terms and Conditions and the Reservation Privacy Policy set out below.

When you make your reservation, whether Online, Online, Online or by telephone (good luck… someone is not good at keeping the office phone charged) or by traveler pigeon (in which case we will offer you a discount and drop almost all of the formalities). You will be deemed to have read, understood, and accepted these Reservation Terms and Conditions and the Reservation Privacy Policy, and those of our affiliate booking systems for events, waivers, and store and restaurant ordering systems. Because we are that tech.

If you make your reservation via a travel agent or other third party, then you have a separate legal relationship with that party and Chillville Collective DBA DayDreamer Domes (DDD) has no liability for any acts or omissions of such party including their observance of your data protection rights. Listen… we want you to buy from us. We want to stay in business, and we will be much kinder to those who took the time to not have to run it through a big small business crushing machine. Don’t be that person, don’t Amazon your vacation. You want experiential, you want a class experience. Go ahead and Amazon order yourself two cute bathing suits, a big hat, and a dope kimono, maybe a hand fan, but please not your journey. Yeah, we said journey. 

When you make your reservation, you will be also deemed to have read, understood, and accepted the terms and conditions for using the DDD website (which shall mean www.daydreamerdomes.com or any related DDD web pages accessible from it) and any relevant terms and conditions shall be deemed to be incorporated into your reservation and the accommodation agreement with the Chillville/ DDD. The link to the terms and conditions for using the DDD website is https://www.daydreamerdomes.com/about/terms/ Eventually… we have to do so many of these documents. So like by Nov of 2023, it will be there. 

Chillville Collective, DBA DayDreamer Domes ("DDD") does not own or manage any of the third-party reservation systems. DDD provides an online reservations facility on the DDD website and a telephone facility for making reservations at DDD . "the Reservations Facility") is an independent service provider and acts solely as an intermediary between you and Chillville Collective, DBA DayDreamer Domes ("DDD"). Accordingly, your reservation and the accommodation agreement is made directly with Chillville Collective, DBA DayDreamer Domes ("DDD") of your choice and your use of the Reservations Facility will not result in any contractual relationship between you and DDD.

All information regarding rooms, facilities, products, and services offered at the Chillville/ DDD contained on the DDD website or otherwise available through the Reservations Facility has been provided to DDD by a Chillville/DDD. DDD does not make any representation or warranty, express or implied, of any kind with respect thereto. Such information may be inaccurate as a result of renovation or repair at the Chillville/ DDD. The DDD website may also contain typographical errors or omissions.

As there will be no contractual agreement between you and DDD, and as DDD does not control or verify the information that Chillville/ DDD submit to or through the Reservations Facility, DDD shall not be liable to you for:

(i) the accuracy or completeness of any Chillville/ DDD information provided to or through the Reservations Facility including, without limitation, the availability or price of rooms, facilities, products or services, or for any other errors or omissions of Chillville/ DDD; or

(ii) any failure or delay beyond its control in the transmission of any data submitted to or through the Reservations Facility including, but not limited to, the details of your reservation or changes to or cancellation of your reservation, in each case to the fullest extent permitted under applicable laws.

RESERVATIONS PROCEDURE AND POLICIES -

1. Online reservations -

The DDD website allows you to check the accommodation offerings and availability of Chillville/DDD (and related products and services), and book. On completion of the reservation process, the Reservations Facility will transmit an online or email confirmation of your reservation. A reservation is only valid when a reservation number has been issued, which will be automatic. If you don’t want to mess with it, call us and we will get back to you and do it for you, but like when we get to it, so if you can be patient we will actually give you a DISCOUNT. Yeah, seriously because we will save money if we do it over the phone. But, like when we have a minute, so don’t get upset if it takes us a day or two to get back. Oh and when you DO call, make sure to have your Identification handy that minute, because you have to send it to us in the same breath, or no discount. You have to text us a copy of your ID. So know that. If not, we spent a lot of time designing our tech because that is the boring stuff, and we want to spend our time making your trip awesome,  not doing administration, we hate administration so let the bots do it for us. You can find anything you need within the pages of our site… and also live a little. Leave some mystery, don’t spoil your trip by sweating the small stuff.  Relevant details relating to products and services must be confirmed by you directly with the Chillville/ DDD including, for example, airport pick-up and drop-off times.

 

2. Hotel Prices -

The prices indicated on the DDD website and other 3rd party booking sites, and by telephone for the Chillville/ DDD rooms, products, and services are subject to availability. Breakfast is only included if indicated in the rate policy. Taxes and service charges are only included if indicated in the rate policy.

3. Payment -

It will be necessary for you to provide credit card details to secure a room, product or service reservation. The credit card may then be used by the Chillville/ DDD for payment of a deposit as advised at the time of booking or as a guarantee for a future payment, in the case of a no-show, a cancellation, or a change to the reservation. 

4. Cancellations and Amendments -

You should make any cancellations or amendments to your reservation using the same DDD channel through which you booked, either online or by telephone. Expedia charges us up to 30% commission so If you booked through those bloodsuckers, no esta mi problema. Regardless of who or why, we are going to charge you $100 because unbooking is a giant pain in the ass. Seriously, and it still costs us credit card fees and time. The cancellations and amendments policy that applies to your reservation will depend on the respective Chillville/DDD's policy as advised at the time of booking. Because if this goes well we already know where we want our next one and we don’t want to have to write this twice. 

5. Rate/Reservation Validity -

Reservation confirmations are provided to you solely for your convenience. We have a user experience link (not app) and DDD and Chillville retain official records of reservation transactions, including details of dates of stay and room, product, and service rates. In the event of discrepancies, alterations, modifications, or variations between this confirmation and our official records, DDD’s official records shall prevail. Dude, it is all on the computer. Tampering with this confirmation to alter any room, product or service rate, or any other reservation information is strictly prohibited and will have legal consequences. What are you going to do? Hack a free room? If you can figure out how to do that, listen, we are building a secret syndicate and we could use a person like you. 

6. Early Departure -

Chillville/DDD has an early departure penalty fee and some room, product, and service rates may also require a minimum stay. You may change your check-out date if it is outside the 45-day window without a fee, if you want to change it without a penalty we will only do it within this period. We are a small business and do not have the staff or the number of rooms to take a hit within that period, especially if your reservation is in the winter, which might be harder to rent. Sell it to a friend, and just call us to tell us what the new name is, and they need to sign a waiver. 

7. Currency -

Reservations will be charged in the hotel’s local currency as shown on the DDD website or given over the telephone at the time of booking. The price shown is based on today’s exchange rate. Any currency conversion is for guidance only. A foreign currency transaction may be charged by your card provider. Any deposits or pre-payments will be deducted from the final reservation invoice in the hotel’s local currency.

A refund of a deposit or prepayment, if any, will be subject to the exchange rate applied by your payment card provider +$100 at the time of any such refund and may differ from the exchange rate applied at the time such deposit or prepayment was made.

8. Rate Requirements -

As some rates have special requirements at check-in, you should verify that you qualify for the rate that you have reserved. Chillville/ DDD is only obligated to honor this rate if you qualify or have proof of qualification. Booking with our AARP rate, you better prove it. Don’t show up without a liver spot and try to fool us, better sport some gray, or be prepared to show your driver's license. Again we have a pool for our employees, and we put bounties on dissidents. If you roll in looking for an AARP rate and don’t qualify, we charge you double the dailey discount rate as a fine and add $100 and we add you to our blacklist. Be young and dumb, but be prepared to own it.  

9. Pre-paid Reservations -

Some rate plans require prepayment in full and are non-cancellable, non-refundable, non-changeable, and non-transferable. This will be identified in the rate description. For these rate plans, once you make a reservation your credit card will be charged for the full amount. Credit will not be given for any unused reservation and the amount paid by you for such reservation cannot be used toward any other/future reservation.

10. Guarantee Rules -

For reservations guaranteed with a credit card at the time of making your reservation, rooms are held until the check-out time until check out. 100% is taken at the time of booking. Chillville Collective may authorize the room, product, or service rate prior to arrival and reserve funds, including taxes, on the credit card to determine the validity of the credit card. Rooms, products, or services booked with an invalid credit card are subject to immediate cancellation.

 

11. Overbooking -

In the event that a guest cannot be accommodated due to the Chillville/DDD overbooking or an unforeseen circumstance, Chillville/DDD will attempt to accommodate guests, at its expense, at a comparable property in the area for the night(s) for which the Chillville/DDD is unable to accommodate such guests, and will pay for transportation to that property.

 

12. Special Requests -

Got a special requirement? Chillville/DDDs will strive to honor any request for specific room types or bed types and some Chillville/ DDDs will confirm such arrangements at the time you make your reservation. Until specific confirmation is issued then your request cannot be guaranteed unattended and neither DDD nor the Chillville/DDD can guarantee that your request will be honored.

13. Pets -

If you plan to travel with your pet, we recommend that you call a local kennel. We do not allow dogs in the pool area, the restaurant, or the store, and we don’t want people to leave animals in their domes unattended. If you have a service animal because of a disability we of course will welcome your service animal. We do have limited pet rooms for all others but the rules stated above apply. Confirm directly with DDD or the Chillville/ DDD that the Chillville/ DDD does accept pets. Please make sure to read the pet policy at any individual Chillville/ DDD. These rooms come at a higher price due to the additional amount of cleaning required post-pet.

14. External services -

The DDD website and telephone facility or the Chillville/DDD at which you stay may advertise the opportunity to purchase products or services from independent third-party suppliers (“independent suppliers”) including, by way of illustration only and without limitation, excursions, boat charters, wine, ski passes (“external services”). The following provisions apply to all external services:

(i) All information on the DDD website or otherwise communicated by DDD regarding external services has been provided to DDD and your Chillville/ DDD    by independent suppliers. Such information does not constitute any endorsement or recommendation of the external service by Chillville/DDD and is for general guidance only. Neither DDD nor your Chillville/DDD makes any representation or warranty, express or implied, as to the nature, quality, cost, or any other aspect of the external services and it is your responsibility to check all relevant details of the external services with the independent supplier prior to purchase or booking.

(ii) DDD and Chillville/DDDs act solely as intermediaries introducing independent suppliers. Your contract for any external services will be made directly with the relevant independent supplier and neither DDD nor your Chillville/ DDD has any other involvement in or control over the provision of external services. Consequently, neither DDD nor your Chillville/ DDD will have any liability to you for the warranties, representations, acts, errors, omissions, breaches, or negligence of any independent supplier or for any accidents, personal injuries, death, loss of or damage to property or any other losses, damages, costs or expenses resulting, directly or indirectly, from your purchase or use of any external service to the fullest extent permitted under applicable laws.

It is your responsibility to check that, where appropriate, the independent supplier has adequate public liability insurance for the external service and/or to ensure that you and any dependents or associates using the external service have adequate personal insurance cover against all foreseeable risks.

15. Guest’s obligations -

You agree to the terms and conditions of purchase imposed by DDD and each Chillville/DDD. You also agree that you are fully responsible and shall pay for all charges, fees, duties, taxes, assessments, and other amounts arising out of your reservation when due, including additional taxes and fees that may not be included in the quoted rate.

You understand that any violation of Chillville/ DDD’s conditions may result in the cancellation of your reservation and you forfeit any monies paid for such reservation and Chillville/ DDD debiting your account for any costs it incurs as a result of such violation.

16. Privacy and data protection -

Our Reservation Privacy Policy (set out below) will apply to your reservation and forms part of these Reservation Terms and Conditions.

17. Intellectual Property Rights -

‘DDD’ have trademark protection. Any copyright and other intellectual property in the content and materials on the DDD website remains with DDD or the relevant Chillville/ DDD. Downloading, copying, or otherwise using any material on the DDD website is permitted only for private use and limited to the sole purpose of making a Chillville/ DDD reservation.

18. Force Majeure -

Neither DDD nor any Chillville/ DDD will be liable for any change or cancellation of any reservation that is caused, in whole or in part, by events, occurrences, or causes beyond the control of DDD or any Chillville/ DDD. Such events, occurrences, or causes include, without limitation, acts of God, terrorist activities, weather, strikes, lockouts, riots, acts of war, earthquakes, volcanic activity, ash clouds, tsunamis, fire, and explosions.

19. Limitations -

Neither DDD nor any Chillville/DDD nor other providers of products or services related to the Reservations Facility are responsible for communication malfunctions, failures, difficulties or lost, stolen, or misdirected transmissions, messages or entries, or the security of any such communications to the fullest extent permitted under applicable laws. Further, neither DDD nor any Chillville/DDD nor any other providers of products or services related to the Reservations Facility are responsible for incorrect or inaccurate entry information, whether caused by user(s), by any of the equipment or programming associated with the Reservations Facility, or by any technical or human error that may occur in the processing of any information related to the Reservations Facility and shall not be liable for damages resulting from any of the foregoing to the fullest extent permitted under applicable laws.

DDD and any Chillville/ DDD may cancel or modify reservations where it appears that a user has engaged in fraudulent or inappropriate activity or under other circumstances where it appears that the reservations contain or resulted from a mistake or error.

20. Governing Law -

These Reservation Terms and Conditions are governed by the laws of United States of America and the courts of United States of America and shall have exclusive jurisdiction in relation to any dispute in relation thereto.

PART 2: RESERVATION PRIVACY POLICY

Protecting your private information is our priority. This Statement of Privacy applies to www.daydreamerdomes.com, and Chillville Collective DBA DayDreamer Domes and governs data collection and usage. For the purposes of this Privacy Policy, unless otherwise noted, all references to Chillville Collective DBA DayDreamer Domes include www.daydreamerdomes.com. The DayDreamer website is a resort website and any related e-commerce activities related to the operation of the resort. By using the DayDreamer website, you consent to the data practices described in this statement. 

DayDreamer Domes ("DayDreamer Domes" or "we". "us", or "our") located at 397 Blue Star Highway, is committed to protecting your privacy. The information that you provide to DayDreamer Domes is utilized in order for us to (among other things) provide you with the highest level of customer service reflective of the quality of our brand.

This Privacy Policy (“Policy”) applies to our offline and online data collection practices, including when you visit our website at www.DayDreamerDomes.com and any website owned, operated, or controlled by us (collectively the “Site”), visit or stay as a guest at DayDreamer Domes, sign up for free Wi-Fi at DayDreamer Domes, contact us regarding hosting corporate events, gatherings, weddings, or other special occasions at DayDreamer Domes, contact us by phone or email, subscribe to our mailing lists or when you engage with us on social media.

Collection of your Personal Information - 

We do not collect any personal information about you unless you voluntarily provide it to us. However, you may be required to provide certain personal information to us when you elect to use certain products or services. These may include: (a) registering for an account; (b) entering a sweepstakes or contest sponsored by us or one of our partners; (c) signing up for special offers from selected third parties; (d) sending us an email message; (e) submitting your credit card or other payment information when ordering and purchasing products and services. We will use your information for, but not limited to, communicating with you in relation to services and/or products you have requested from us. We also may gather additional personal or non-personal information in the future.

DayDreamer does not sell, rent or lease its customer lists to third parties. DayDreamer may share data with trusted partners to help perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide these services to DayDreamer, and they are required to maintain the confidentiality of your information.

DayDreamer may disclose your personal information, without notice, if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with the legal process served on DayDreamer or the site; (b) protect and defend the rights or property of DayDreamer; and/or (c) act under exigent circumstances to protect the personal safety of users of DayDreamer, or the public. 

We collect personal information about you in the following ways: 1) from you when you voluntarily submit information directly to us; 2) using automated technology, including when you visit our Site, social media, or properties or interact with our electronic advertisements or communications; and 3) using third party sources, including our service providers, analytics providers, through social media and other websites or services we interact with. Automated technology collects information from your computer or mobile device and includes cookies, web beacons, locally shared objects, or other similar technology. More information is given below in the "Cookies and Other Technology" section below.

All personal information may be used for the purposes stated in this Policy.  We will retain your personal information for the period necessary to fulfill that purpose and as otherwise needed to comply with applicable law and internal company policies.

We may combine data collected from third-party sources.

We collect, use, and disclose your personal information as described in the chart in Annex 1 below. 

Our third-party providers are bound by confidentiality obligations and are restricted to only using the data to provide our business with applicable services.

Retention of Data -

We will retain your personal information (collected through offline and online methods) for as long as it is necessary for the purposes described in this Policy. We will also retain and use your personal information to the extent necessary to comply with our legal obligations, resolve disputes, and enforce our legal agreements and policies.

Intended Audience of Websites; COPPA Compliance -

We are in compliance with the requirements of the Children's Online Privacy Protection Act (“COPPA”).  We do not knowingly collect information from minors in the United States or elsewhere with or without the consent of their parents or guardians.  If you are not 16 or older, you should not visit or use our Site or social media accounts.  If you become aware that a child has provided us with personal information without appropriate consent, then please contact us using the details below so that we can take the appropriate steps in accordance with our legal obligations and this Policy.

Email Marketing & Communications -

From time to time, DayDreamer may contact you via email for the purpose of providing announcements, promotional offers, alerts, confirmations, surveys, and/or other general communication. In order to improve our Services, we may receive a notification when you open an email from DayDreamer or click on a link therein. If you would like to stop receiving marketing or promotional communications via email from DayDreamer, you may opt out of such communications by clicking the unsubscribe button. If you no longer wish to receive email marketing communications from us, you may opt-out of receiving marketing-related emails by using the unsubscribe method provided in our communications (e.g., by clicking on the “unsubscribe” link in the email to unsubscribe). Please note that unsubscribing from our promotional material will not prevent us from contacting you for other reasons, such as order confirmations, responses to customer service inquiries, or information about an event for which you have registered.

Security -

For your security, our web-based ordering system utilizes the most up-to-date Secure Socket Layer (SSL) technology. This software ensures that all sales transaction information is transferred safely via encrypted methods.

All orders placed on the Site require a credit card. Upon submitting an order, all credit card numbers are transmitted via secure and encrypted methods. If desired, credit card numbers can be kept on file for future purchases. For your security, these credit card numbers are stored in secure, encrypted databases.

The transmission of information via the Internet is not completely secure. Although we strive to protect your personal information in accordance with this Policy, we will not be liable for the disclosure of personal information obtained due to errors in transmission or security breaches.

This information is used for the operation of the service, to maintain the quality of the service, and to provide general statistics regarding the use of the DayDreamer website. 

RIGHT TO KNOW ABOUT PERSONAL INFORMATION COLLECTED, DISCLOSED, OR SOLD -

You have the right to request that we disclose to you the following information about the personal information we collect from you:

  • categories of personal information collected;

  • categories of sources of personal information collected;

  • the business or commercial purpose for collecting or selling personal information;

  • the categories of third parties with whom we share personal information; and

  • Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law;

  • Comply with the California Electronic Communications Privacy Act;

  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the achievement of such research, provided we have obtained your informed consent;

  • Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us;

  • Comply with an existing legal obligation; or

  • Otherwise use your personal information, internally, in a lawful manner that is compatible with the context in which you provided the information.

Within the past 12 months, we have collected the categories of personal information about California consumers as described in this Policy in the section labeled “Information Collection and Use of Information.

We have not sold any personal information to third parties for business or commercial purposes in the preceding 12 months.

RIGHT TO REQUEST DELETION OF PERSONAL INFORMATION -

You have the right to request the deletion of your personal information collected or maintained by us (“Request to Delete”), subject to certain exceptions permitted by law.

To make a Request to Delete, please submit a verifiable consumer request pursuant to the instructions below. You may only make a Request to Delete twice within a 12-month period.  We will acknowledge your Request to Delete within 10 days and will attempt to respond substantively within 45-90 days.

The Request to Delete must provide sufficient information to allow us to verify that you are the person about whom the personal information was collected, sold or disclosed and must contain sufficient detail to allow us to properly understand, evaluate and respond to your request.  If we cannot verify your identity, we will not be able to respond to your request. Additionally, as permitted by law, if the information requested to be deleted is necessary for us to maintain, we will not be able to comply with your request.  We will notify you if this is the case.

A Request to Delete requires two steps: 1) making the Request to Delete and 2) confirming that you want your information to be deleted.

Once we receive your initial request to delete and your separate confirmation to delete, we will need to verify that you are the person that is the subject of the request (the “Verification Process”). The Verification Process consists of matching identifying information provided by you with the information we have about you in our records. 

Depending on the sensitivity of the personal information you are requesting to delete, we may need to match two or three pieces of identifying information from your request with information from our records.  If your request to delete involves deleting very sensitive information, we may also need a signed declaration stating that you are the consumer whose personal information is the subject of the request.

We will retain correspondence, documents, and information related to any Request to Know, Request to Delete, or Request to Opt-Out for 24 months as required by law.

RIGHT TO OPT-OUT OF SALE OF PERSONAL INFORMATION -

You have the right to opt-out of the sale of your personal information.  We do not and will not sell your personal information.  If this changes in the future, we will provide you with the required notice and the right opt-out.

RIGHT TO NON-DISCRIMINATION FOR EXERCISING CONSUMER PRIVACY RIGHTS -

You have the right not to receive discriminatory treatment for exercising your privacy rights conferred by the California Consumer Privacy Act, including by exercising the rights specified herein.

You may designate an authorized agent to make a request on your behalf under the California Consumer Privacy Act.

When your authorized agent makes a request related to your personal information, we will require the agent to provide the above-written permission.  We may also require that you verify your own identity directly with us at the time such a request is made.

California Do Not Track Notice:

Because there are not yet common, industry-accepted “do not track” standards and systems, our website does not respond to Do Not Track signals.  In addition, we may allow third parties to collect personal information from your activity on our website, as described in the “Information Collection and Use” section above and described in Annex 2 below.

Changes to This Privacy Policy -

This  Policy may be revised from time to time for any reason.  If this  Policy changes, the revised policy will include a new effective date, and we will notify you of such changes by posting the revised policy on this page.  Be sure to check the Policy whenever you submit personal information to us.

When you visit our Site (including your online activities on our Site), make hotel accommodations using our Site or via phone, register as a DayDreamer Domes hotel member, make an inquiry about hosting an event at DayDreamer Domes (through our Site, in person, or by phone), sign up for free Wi-Fi at DayDreamer Domes, host an event at DayDreamer Domes, otherwise volunteer your information to us, enter a promotion or competition conducted by us including dropping your business card, engage with us on social media, or otherwise interact with us through posting content on our Site, or communicate with us via phone (including text) or email. 

We may also collect information from third-party sources, such as Expedia, travel agencies, third-party service providers, opt-in lists, publicly available data, consumer reporting agencies, other companies, and referrals

Your computer or mobile device, through your online activities and interactions with us, including, without limitation, your use of our services, your online activity on our Site, and on our social media channels or through our third-party sources. 

Third-party sources such as Expedia, third-party service providers, travel agencies, opt-in lists, publicly available data, consumer reporting agencies, other companies, and referrals

Your in-person visit to our property, including but not limited to our restaurants, hotel bars, lobby, parking lot, conference rooms allotted for events and meetings, and other general areas.

Personal Identifiers - name, signature, mailing address, telephone number, email address, date of birth, location.

Commercial Information -services such as reservations for stay and events purchased, obtained, considered, reviewed, or other purchasing or consuming habits

Internet/Network Activity - IP address, your device information, domain name, browsers you used to access our Site and services, webpages viewed, time spent on webpages, links clicks, transactions entered into, and site-navigation patterns

How we use it:

- To make and fulfill guest reservations, send you communications regarding your reservations – including confirmation and receipt, communicate with you during your stay, provide customer service and support, respond to your request for proposals regarding hosting events at DayDreamer Domes, follow up with you after you have communicated with us or submitted information to us regarding your stay or your request for a proposal; 

- To improve our business operations, property, and services including event hosting offerings, Site, and social media;

- To provide you with a customized user experience;
- To send promotional communications or marketing offers (unless you have requested that we not send such communications); 

- For marketing, research, legal, and other business purposes; 

To comply with our policies, procedures, and legal obligations, including complying with law enforcement or governmental authority requests, investigating fraudulent activity, resolving disputes, and enforcing our legal agreements and policies. 
- Analyze and track usage of our services including our Site and social media accounts; - Determine the popularity of our property, Site, and other related services including but not limited to event hosting; Better understand how you use our Site and services; Develop new service offerings; Enhance, modify, or improve our Site, services, and products; Provide you with a customized guest experience and present offers tailored to your personal preferences;

To send promotional communications or offers including invitations to events, taking surveys, and participating in promotions (unless you have requested that we not send such communications); 

- For other marketing, research, legal, and other business purposes; To comply with our policies, procedures, and legal obligations, including complying with law enforcement or governmental authority requests, investigating fraudulent activity, resolving disputes, and enforcing our legal agreements and policies.
- To maintain and preserve the security and safety of our guests, employees, premises, and property; to improve our premises and your customer experience; and to comply with our policies, procedures, and legal obligations, including complying with law enforcement or governmental authority requests, investigating fraudulent activity, resolving disputes, and enforcing our legal agreements and policies.

- Service providers, and contractors that we use to support our business and operations (e.g. Expedia, vendors hosting or operating our Site, entities that deliver marketing messages and advertisements, and fraud detection service providers entities that provide event-based services such as catering) who have agreed to keep the information confidential and use it only to provide the applicable services; 

- Third-party payment processors, including in connection with transactions where we require credit or debit card account information such as credit or payment card account information (including card number, expiration date, and security code); 

- Third-party companies we work with who help to gather information from you or help us to communicate with you, entities that assist with data analytics, analyzing Site metrics, advertising, and behavioral remarketing.

Your continued use of the website and/or Services available after such modifications will constitute your: (a) acknowledgment of the modified Privacy Policy; and (b) agreement to abide and be bound by that Policy.

In consideration for myself, and all persons entering under MY SUPERVISION, being permitted to camp and participate in the activities at Chillville Collective DBA Daydreamer Domes, I and all persons listed below, agree to the following Waiver and Release: I hereby KNOWINGLY AND INTENTIONALLY WAIVE AND RELEASE, INDEMNIFY AND HOLD HARMLESS, Chillville Collective DBA Daydreamer Domes Camping, Flying Fojtiks LLC, all officers, employees, and volunteer family members of any and all liability for injuries caused by, but NOT LIMITED TO, the following activities: CAMPFIRES, HIKING, FISHING, SWIMMING, HOT TUB, PLAYGROUND EQUIPMENT, WAGON RIDES, PLANNED EVENTS, DOGS, SHOWERS, SPEED BUMPS, BICYCLE, MOPED, GOLF CARTS, ELECTRIC SCOOTERS AND ENCOUNTERS WITH WILDLIFE. I acknowledge that camping has many hazards and that there are risks that cannot be eliminated, particularly in a wilderness environment.

 

I hereby acknowledge that Chillville Collective DBA Daydreamer Domes is not responsible for any theft, loss, or damage incurred during my stay.  My signature below confirms that I have read and agree to abide by all rules and policies at Chillville Collective DBA Daydreamer Domes. These policies are available on our customer experience and check-in app, as well as on our website. 

 

I also understand that I can be asked to leave the property, without a refund, for failure to follow said rules and policies. I hereby consent to photographs and videos taken of me and all parties listed below during our stay at Chillville Collective DBA Daydreamer Domes for purposes of event documentation and promotion of Chillville Collective DBA Daydreamer Domes. Names will not be published. 

My signature confirms that I have a valid rabies certificate for any pets or service animals in my party. A copy will be provided if necessary. I have reviewed and read the Swimming Pool policies mandated by Allegan County Health Department. The Swimming Pool policies are as follows, but NOT LIMITED TO: 

• THERE ARE NO LIFEGUARDS ON DUTY – Swim at your own risk • NEVER SWIM ALONE. A minimum of two adults, 18 years of age or older must be present whenever this swimming facility is in use, with at least one adult remaining on the pool deck. Do not use alone. 

• THERE IS NO SUBSTITUTE FOR ADEQUATE SUPERVISION. We do not allow Children under 5 years of age at the resort. Any child over the age of 5 must be accompanied to the swimming facility by a parent or guardian, (an adult who is responsible for the children and their behavior) 

• IN CASE OF AN EMERGENCY, NOTIFY 911 IMMEDIATELY AND NOTIFY THE FACILITY OPERATOR. A free telephone is provided at this facility. (Front Porch of the Main Office and at the pool patio). 

• Only use the swimming facility during posted hours of operation 

• No Diving into the swimming pool, No jumping into the swimming pool. 

• Do not drink alcohol and swim. Do not use while under the influence of anticoagulants, antihistamines, vasoconstrictors, vasodilators, stimulants, hypnotics, narcotics, or tranquilizers.

 

• Elderly persons, and those suffering from heart disease, diabetes, high or low blood pressure, should be prohibited from using the spa pool. 

• Observe reasonable time limit. (i.e. 15 minutes), then shower, cool down and if you wish, return for another brief stay. Long exposure may result in nausea, dizziness or fainting. 

• Help can be obtained by using the emergency telephone and posted telephone numbers for police, fire department, physician, ambulance and hospital. 

 

I have reviewed and read the Pool policies mandated by Allegan County Health Department. The Pool policies are as follows, but NOT LIMITED TO MICHIGAN DEPARTMENT OF ENVIRONMENTAL QUALITY DRINKING WATER AND RADIOLOGICAL PROTECTION DIVISION PUBLIC SWIMMING POOLS: R 325.2192 Swimming pool use. (By authority conferred on the Department of environmental quality by sections 2226, 2233, and 12522 of 1978 PA 368, MCL 333.2226, 333.2233, and 333.12522) 

How could we forget the section on the float tanks. 

 

SENSORY DEPRIVATION TANK WAIVER:

In consideration of being allowed to participate in the sensory deprivation tank experience provided by Chillville Collective LLC DBA DayDreamer Domes], I, the undersigned participant, hereby acknowledge and agree to the following terms and conditions:

  1. Assumption of Risk: I understand that the sensory deprivation tank experience involves complete isolation in a tank filled with saltwater at body temperature. I am aware that this experience may induce a state of sensory deprivation, including complete darkness and silence, which may result in altered sensations, perceptions, and relaxation. I acknowledge that I am voluntarily participating in this experience with full knowledge and understanding of the associated risks and discomforts.

  2. Health and Medical Conditions: I certify that I am in good health and do not have any medical conditions or physical limitations that would prevent me from safely participating in the sensory deprivation tank experience. If I have any concerns about my health or any medical conditions, I have consulted with a medical professional and obtained their approval prior to participating.

  3. Release and Waiver of Liability: I hereby release, waive, discharge, and hold harmless Chillville Collective LLC DBA DayDreamer Domes], its owners, employees, agents, and representatives from any and all claims, demands, causes of action, liability, loss, damage, or injury, whether known or unknown, arising out of or in connection with my participation in the sensory deprivation tank experience. This release and waiver of liability includes, but is not limited to, any negligence or other act or omission by Chillville Collective LLC DBA DayDreamer Domes].

  4. Personal Belongings: I understand that I am solely responsible for any personal belongings I bring with me to the premises of Chillville Collective LLC DBA DayDreamer Domes]. I release Chillville Collective LLC DBA DayDreamer Domes] from any liability for loss, theft, or damage to my personal belongings during my participation in the sensory deprivation tank experience.

  5. Code of Conduct: I agree to comply with all instructions, guidelines, and rules provided by Chillville Collective LLC DBA DayDreamer Domes] regarding the use of the sensory deprivation tank and the premises. I understand that failure to comply may result in termination of my session without refund.

  6. Confidentiality and Non-Disclosure: I understand that the sensory deprivation tank experience may involve personal insights and experiences. I agree to keep any information or experiences gained during the session confidential and not disclose them to others without the express permission of Chillville Collective LLC DBA DayDreamer Domes].

  7. Photography and Videography: I consent to Chillville Collective LLC DBA DayDreamer Domes] taking photographs or videos during the sensory deprivation tank experience for promotional and marketing purposes. I understand that my identity will be protected, and my personal information will remain confidential.

  8. Severability: If any provision of this waiver is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.

I have read this waiver and fully understand its contents. I am aware that by acknowledging the T&C of I have had an opportunity to read this document thoroughly.
